By accessing or using the website kaneoheinsulation.com (the "Site") or by engaging Kaneohe Insulation("we," "us," or "our") for any service, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site or engage our services.
These Terms apply to all visitors, customers, and others who access or use the Site or engage us for services.
Kaneohe Insulation provides residential and commercial insulation installation and removal services in Kaneohe, HI and surrounding areas. Services include, but are not limited to, spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, vapor barrier installation, air sealing, and related work.
All services are subject to availability, scheduling, and completion of a satisfactory on-site assessment. We reserve the right to decline any project that falls outside our service area, scope of work, or safety standards.
Estimates provided by Kaneohe Insulation are free of charge and based on conditions observed during an on-site assessment. All estimates are provided in writing before any work begins.
Estimates are valid for 30 days from the date issued unless otherwise noted. Pricing may be adjusted if conditions at the property materially differ from what was observed during the estimate visit, or if the scope of work changes at the customer's request. Any scope changes will be discussed and agreed upon in writing before additional work proceeds.
Estimates do not include permit fees, which are the customer's responsibility unless specifically included in a written agreement.
Once you accept a written estimate and schedule a date for work, we ask for at least 48 hours' notice if you need to reschedule or cancel. Late cancellations or no-shows may result in a scheduling fee at our discretion, which will be communicated to you in advance.
We will notify you as early as possible if we need to reschedule due to weather, crew availability, or other circumstances. We will work with you to find the earliest available alternative date.
You are responsible for preparing the work area before the crew arrives, as outlined in the pre-job instructions provided at booking. Failure to prepare the space adequately may delay the start of work and, in some cases, require rescheduling at your expense.
Payment terms will be stated in your written estimate or service agreement. For most residential projects, payment is due upon completion of the work and your approval of the finished job. For larger commercial projects, we may require a deposit prior to scheduling, with the balance due upon completion.
Accepted payment methods will be communicated at the time of booking. Invoices not paid within 30 days of the due date may be subject to a late fee and referral to a collections process. You agree to reimburse us for reasonable costs of collection, including attorney's fees, if applicable.
We stand behind our work and will address any defects in our installation that arise from errors in workmanship. Specific warranty terms, including duration and coverage, will be stated in your written service agreement.
Manufacturer warranties for materials used in your project are subject to the terms of the applicable manufacturer. We make no independent warranty for material performance beyond what is provided by the manufacturer.
Our warranty does not cover damage caused by water intrusion, pest activity, structural movement, improper use, or modifications made by others after the completion of our work. The Site and all information on it are provided "as is" without warranty of any kind, express or implied.
To the maximum extent permitted by applicable law, Kaneohe Insulation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or our Site, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a specific project shall not exceed the amount paid by you for that project. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You may not use the Site to transmit spam, malware, or any content that is unlawful, harmful, or objectionable. We reserve the right to restrict or terminate access to the Site at our discretion.
All content on the Site - including text, images, and logos - is owned by Kaneohe Insulationor our licensors and may not be reproduced, distributed, or used for commercial purposes without our written permission.
If you have a dispute with Kaneohe Insulation regarding services performed, please contact us directly first at quotes@kaneoheinsulation.com so we have the opportunity to resolve the matter. We take complaints seriously and will make a good-faith effort to reach a fair resolution.
If we cannot resolve the dispute directly, the parties agree to attempt mediation before pursuing other legal remedies. Nothing in this section prevents either party from seeking injunctive or other equitable relief where appropriate.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any legal action arising out of or related to these Terms shall be brought in a court of competent jurisdiction in the State of Hawaii.
We reserve the right to update or modify these Terms and Conditions at any time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site or our services after any changes constitutes your acceptance of the updated terms.
